On Nov. 30, 2004, Act 204 of 2004 amended 35 P.S. Chapter 13A, charging the Pennsylvania Department of Agriculture, Amusement Rides Division with regulation of consumer fireworks.  Act 204 of 2004 that amended 35 P.S. Chapter 13A further mandates in section 1275.4 in part that, "Applications for licenses to sell consumer fireworks shall be submitted to the Department of Agriculture on forms prescribed and provided by the department.  The license application shall be accompanied by an annual license fee of five thousand dollars ($5,000) per location."
